Florida House of Horrors. Murders.Would you disclose the murders?

Hey everybody, I have a link that you can listen to the big story on the Florida House of Horrors with 3 murders.  The Realtor did not tell them about the murders because he didn't have to disclose by law.  The newscaster asked them if they were upset with the Realtor and they said no when they found out he did not have to disclose.  What would you do?  Even if you didn't have to disclose would you???

Gloria, I would disclose it, even if I wasn't obligated to, which I am, in my state.  As I said in a previous post, people die in homes all the time of both natural and unnatural causes (suicide, not a required disclosure in my state).  A violent death(s) at the hand of another person is another thing entirely.  Some people will be "spooked" by this, others will not.  But the Seller (and Agent) will always face some sort of ramification for not disclosing this.  Some may say "Buyer Beware" and the Buyer should have been paying attention to the news, but I would have to disagree with that.

Mind you, I have dealt with a death in the home but never a murder.  So take that for what it's worth.  Again, Not Much!

When I lived in California.  They had a gruesome murder in one of the nearby neighborhoods.  People were driving by 24/7 to look at the house.  I thought it was morbid.  I would disclose the murders even if I lived in a State that did not require it.  However, I have often thought that very odd people would be attracted to this type of home.

I'm all for disclosure, and I commented on the same story over at AR.  I've slept in a morgue and I don't know of any bedroom that would come close to the experience. Well maybe my ex's. I also went to a lot of lunches with the local coroner and this man loved to talk shop.  Are the owners being a bit sensitive? Would they feel better if they had gotten a death discount?  Hasn't somebody died on every piece of real estate in the country?

If your state does not require you to disclose it and you are the listing agent you may get yourself fired (maybe even sued) for disclosing it.  If it were my home and my agent disclosed it to everyone that showed interest I would terminate the listing and find an agent that realized they "represent me" and my interest in the home not the buyers.

I agree with Paul.  If seller asks for no disclosure, listing agent must abide unless it's against the law.  Buyer's agent on the other hand...Is it really a material fact that affects the property the same as if you knew there was a termite problem?

If I am the listing agent, I would try to counsel them to be upfront and not try to hide what is common knowledge.  but if my client, the seller, said do not disclose... I either have to abide or not take the listing.

Now, if I am the buyers agent, I would disclose.  Heck, I probably wouldn't have it on my list of potential homes to view unless the buyer insisted and then I would tell them before we ever went near the house.  Let's not waste our time if this is a problem for you...

I'm in Florida and wouldn't disclose it.  It has nothing to do with the value of the property.  The property didn't do anything, the previous owners did.  It's the same if someone dies of aids in the home.. we aren't to disclose that either.   You are not allowed, by law, to stigmatize a property here.  The agent and the broker did the right thing.
