Property Boundary Lines

If you want to know exactly where the property line is, just watch the neighbor cut the grass.   Big Smile

Well, I'm sure we've all been asked the question, and I'd bet we all responded ethically:

Question for Realtor from Potential Buyer:  "Where are the property lines?"

Realtor: "For an exact answer, you would need to have a surveyor make that determination.  But I think on this side it's near the street, and on that side it's near that tree....."

Fortunately, I've not run into many property line disputes, but the few I've been involved with concerned the placement of fences.  "Open and notorious..."  Dangerous words!

So, any great stories out there about such issues?  I'm sure we'd love to hear them!

There is a property I have listed that has an OLD OLD survey marker from a hundred years ago. It's the most fascinating thing! Huge wood stake with metal plate on it . . . and carved on one side (the wood side). It's on a mining claim. It's really neat.

We learn straight out of the gate in this business not to assume anything. It make sense that your neighbor will not mow any more than what is his so that is a pretty good indicator of property lines. But the house we own, our mailbox sits on the neighbors property 2 feet over from the West side of our driveway and I found out that our line is only to the West side of the driveway.

So my husband goes and tells the neighbor because he wants to plant trees in that little 2 ft area. The neighbor, who is a bonified idiot decides no we can't plant trees there because if a limb falls on his car blar blar blar. He just found out he owned it, never mowed it but now is taking control. Good thing is he moved. The new guys mows only with a full moon I guess, so we mow it and act like its ours. Haven't told the new neighbor, I figured that was his problem. We planted trees to shade our house. Now I told you, I am going to have to kill you. lol

Septics are a big issue here.  On a sale last year, I was the BA and we determined that the neighbor's tank had been installed over the property line.  Thankfully, my Buyer was not a stickler and we were able to get through it.

My own septic which was installed 40 years ago was over the line by about 6 inches to the back woods which happens to be owned by the County.  No one ever realized it because the builder had cleared the lot a full 20 feet back from the property line.  That land can never be used but the Board of Health wasn't going for it.  Had to be moved.
